In a recent decision by the Upper Tribunal it was accepted that our Zimbabwean client would face insurmountable obstacles in re-establishing his life in Zimbabwe as a result of the Zimbabwean authorities’ current policy on removals from the United Kingdom.
Currently, the Zimbabwean authorities only accept the return of Zimbabwean nationals from the United Kingdom if the returnee confirms in writing to the Zimbabwean High Commission that they wish to return voluntarily.
The Immigration Judge of the Upper Tribunal who heard our client’s appeal stated:
“I have found that his inability to return to Zimbabwe as a result of the Zimbabwean authorities’ policy on returns of its nationals means that there are insurmountable obstacles to family life continuing in Zimbabwe…”
If you are a Zimbabwean national who has been refused asylum, this decision may support a successful human rights claim to remain in the United Kingdom.
